VISAYA is primarily a contact center and business services company and does not operate a general-purpose consumer SMS marketing subscription program through this website. If VISAYA elects to send SMS messages in its own name, such messages will be limited to authorized, company-owned or company-controlled SMS devices, numbers, and approved messaging systems, operated by designated personnel. Depending on the specific program and the recipient’s consent or other lawful basis, such messages may concern an inquiry, scheduled consultation, appointment or event reminder, service or account-related update, or a separately opted-in promotional communication. Message frequency varies according to the nature of the interaction or program.

Where an individual has expressly opted into recurring VISAYA SMS communications, VISAYA will maintain appropriate consent records and honor withdrawals. Recipients may reply STOP to the originating number to request cancellation of future VISAYA SMS messages and reply HELP for assistance where that message channel supports keyword responses. If the originating channel cannot technically process a reply, or if a response is not received, recipients may email dpo@visayakpo.com with their mobile number and opt-out request. VISAYA will process valid requests and suppress further optional messages, subject to legally required or separately authorized communications. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The SMS restrictions above apply to VISAYA-originated messaging and do not authorize VISAYA to use, sell, or repurpose mobile data processed on behalf of its clients. Client-directed communications are governed by applicable contracts, instructions, privacy notices, and laws.

We may engage authorized service providers for hosting, information technology, security, recruitment support, analytics, messaging delivery, or similar operational services, subject to appropriate data-protection obligations. We may disclose data to competent authorities where legally required or otherwise permitted by law. Where data is stored or processed outside the Philippines, we apply legally required safeguards. SMS opt-in data and consent remain subject to the specific non-sharing commitment stated above.

We use reasonable organizational, technical, and physical safeguards appropriate to the personal data and risks involved. Information is retained only for as long as reasonably necessary for the declared purposes, applicable contracts, legitimate recordkeeping requirements, and legal obligations, after which it is securely deleted or anonymized as appropriate. Actual retention schedules may differ according to record type and applicable law.

Subject to applicable law, individuals may request information about processing, access and correction, object to certain processing, seek erasure or blocking, request portability where applicable, withdraw consent, file a complaint with the National Privacy Commission, and pursue other available remedies. Withdrawal of marketing or SMS consent does not affect processing lawfully carried out before the withdrawal or data that must be retained on another lawful basis.
